Many states are changing their licensing statutes and regulations to reflect the model licensing procedures of the National Association of Insurance Commissioners (NAIC). This means individuals licensed as insurance producers are undergoing a transition to license renewal dates that are based on their date of birth.

PIA has tried to make this transition as painless as possible for our members by giving you the information you need to properly comply with the latest changes. Below are resources regarding licensing changes in New York, New Jersey, Connecticut and New Hampshire.

Transition period license renewal dates. One feature of the transition period in most states will be a unique licensing period that begins on the usual date but ends on a date reflecting the producer’s birth date. Each state has different rules for these transition period licenses.

Flood continuing education requirement
The flood continuing education requirement is not being required by the New York State Insurance Department for license renewal, however, if you are a licensed producer and write business through the National Flood Insurance Program you will be required to take a one-time, three-hour flood insurance course that meets the FEMA-approved requirements. Also, if you participate with a write-your-own (WYO) flood insurance company, the WYO carrier may require a flood insurance course be taken by some or all of your licensed staff. It is recommended that you contact your WYO carriers to find out what their specific requirements will be. The New York State Insurance Department has come released information available at http://www.ins.state.ny.us/agbrok/ab_fld_pc.htm. Continuing education requirement

Fifteen continuing education credits regardless of how long the transition period license is (two years to less than four years); system of qualifying courses for property/casualty, life or both (“bridge”) renewals is unchanged. New licensees are not subject to New York continuing education requirements until their first full biennial license period.

Continuing education requirement
New licenses and transition-period renewal licenses. Producers must complete 24-credit hours of continuing education regardless of the duration of their transitional license (which can run 18 to 29 months). Of the 24 continuing education credit hours, three must be related to professional ethics. For producers with property authority, who write flood insurance, a three-credit course approved by the National Flood Insurance Program (NFIP) is required. Done once, the flood continuing education requirement does not have to be repeated. Of the remaining continuing education hours needed, the requirement that they be in the authorities for which the producer is licensed, is deleted.

Flood continuing education requirement

Producers with property authority and who write flood, are required to complete a three-credit flood course that meets the FEMA-approved requirements for the first renewal following the initial issuance or initial renewal of a license on or after Jan. 1, 2007, one time only. All new licensees with property authority must complete the flood program as approved by the NFIP.

Continuing education requirement
Producers issued renewal licenses that expire on their birth date in 2007 must complete 12 continuing education credits before their birth date in 2007—at least three in each major line held and at least three in law/regulation/ethics. Producers issued renewal licenses that expire on their birth date in 2008 must complete 24 continuing education credits before their birth date in 2008—at least six in each major line held and at least three in law/regulation/ethics. Major lines include: property/casualty, life, accident & health and personal lines. Newly licensed producers must complete the 24-credit requirement for renewal.

Flood continuing education requirement
Resident property/casualty producers must complete a one-time, three-credit flood insurance course that meets the FEMA-approved requirements. The three credits will be applied to the licensee's total property/casualty credit requirement. Producers must complete course prior to the first time their licenses renew on or after Aug. 1, 2007. Producers with birth dates in August 2007 may complete the course any time in the month of August.

Continuing education requirement
Effective with all new licenses issued on or after Jan. 1, 2007, and all current licenses which expire on or after April 30, 2007, all producers will be required to obtain a total of 24 continuing education credits in each renewal cycle, which shall include at least three but not more than 10 credits in ethics (former requirement has been 30 credits).

Flood continuing education requirement
All resident insurance producers (not just property/casualty) must complete a one-time, three-credit course that meets the FEMA-approved requirements. The three credits will be applied to the licensee's total property/casualty credit requirement. Producers must complete course no later than Dec. 31, 2007.
